Version 1.6, dated 5 October 2026. Published by GuyWay Inc. with the Driver Standards under clause 8 of the Platform Access and Collection Agency Agreement (the "Platform Agreement"). Capitalised terms have the meanings given in the Platform Agreement and the Vehicle Rental Agreement (the "Rental Agreement").
This notice explains what information GuyWay Inc. ("GuyWay") collects about you as an independent transport operator who uses the Platform and rents a Vehicle, why it is collected, who can see it and how long it is kept. It applies to you from the date you acknowledge it in the driver application. It does not change your Platform Agreement or your Rental Agreement; where they differ, the agreements prevail.
1. Who is responsible for your information
GuyWay Inc. (company number 18467), of 2874 Greenfield, Providence, East Bank Demerara, operates the Platform and owns the Vehicle. It is responsible for all the information described in this notice. Questions and complaints about your information may be sent to Peter Lorenzo, Chief Executive Officer, at Peter@guyway.gy, or raised through the driver application.
2. What we collect
(a) Identity and contact details: name, address, telephone number, email address and national identification or passport number.
(b) Licences and checks: your licences, TIN and NIS registration, and the results of the checks to which you consented under clause 4.3 of the Platform Agreement.
(c) The bank account you designated for settlement of your Statements.
(d) Data from the driver application, your telephone and the Vehicle while you are logged on to the Platform, including their location and how the Vehicle is driven, and records of your use of the Platform, including the trips and trip requests handled through it.
(e) Vehicle telematics: the location, condition and operation of the Vehicle, recorded whenever the Vehicle is in use, whether or not you are logged on (clause 6.1 of the Rental Agreement).
(f) Hub closed-circuit television footage recorded when the Vehicle is delivered to you or returned by you.
(g) Rider feedback and complaints relating to trips you supplied, and accident and incident reports.
(h) Statement and payment records. Your Statements are issued, and the amounts due to you and by you are paid, in Guyana dollars (GYD).
(i) The record of your acceptance of each version of your Platform Agreement, your Rental Agreement and this notice (clause 14 of the Platform Agreement and clause 11 of the Rental Agreement).
(j) Your documents: the photographs of the documents you scan in the driver application, and the details read from them and confirmed by you.
(k) Your profile photograph, which is shown to riders as described in section 5(d).
(l) The battery level of your telephone, and whether it is charging or in power-saving mode, sent by the driver application with your location while you are logged on to the Platform.
(m) The messages and voice notes you exchange with a rider through the driver application, and the translation of each written message.
(n) The name, telephone number and relationship to you of each emergency contact you give in the driver application.
3. When your location is recorded
The driver application records your location only while you are logged on to the Platform. When you log out, it stops. The Vehicle's own telematics continue to record the location and use of the Vehicle whenever it is driven, because the Vehicle belongs to GuyWay and is insured by GuyWay. Nothing records your location when you are not logged on and not in the Vehicle.
4. Why we collect it
(a) To operate the Platform: to match trip requests, calculate Fares under the Rate Card and issue receipts.
(b) To collect Fares on your behalf and to settle your monthly Statement (clause 6 of the Platform Agreement).
(c) To protect, insure, charge and maintain the Vehicle (clauses 5 to 8 of the Rental Agreement).
(d) To meet legal obligations to the Guyana Revenue Authority, the National Insurance Scheme, the police, the licensing authorities under the Motor Vehicles and Road Traffic Act, Cap. 51:02, and our insurer.
(e) To investigate accidents, rider complaints and disputes about the condition of the Vehicle.
(f) For your safety and the safety of riders.
(g) To record and to evidence your acceptance of your agreements and of this notice.
(h) To read your documents: when you scan a document, an automated assistant reads the printed details and fills in the form for you. You check every field and correct anything that is wrong before you send it, and a member of GuyWay staff reviews the document before it is approved. The assistant makes no decision about you.
(i) To operate and plan the service, including dispatch, the number of Vehicles and slots offered at each time and place, and the analysis and forecasting of demand.
(j) To reduce how often the driver application sends your location when the battery of your telephone is low, and to let GuyWay staff see when your telephone may soon stop working while you are logged on.
(k) To translate the written messages between you and a rider into the language of each of you.
GuyWay does not use this information to supervise, direct or control you in the provision of transport services. Declining or ignoring a trip request or a suggestion is free and carries no consequence of any kind. Its only effects are that the same trip request is not offered to you again and that no further suggestion is sent to you for a short period (clause 3.2 of the Platform Agreement).
5. Who can see it
Inside GuyWay, only the staff who need the information for the purposes in section 4 have access to it.
Photographs of your documents are stored encrypted and can be opened only by you and by the GuyWay staff authorised to review documents.
Outside GuyWay, your information may be shared with:
(a) the service providers that host the Platform, process payments and supply the Vehicle's telematics, some of which are located outside Guyana;
(b) our insurer, in connection with your approval as an Authorised Driver and with any claim;
(c) the police, the Guyana Revenue Authority and other competent authorities, where the law requires it;
(d) a rider, and any person with whom the rider shares the trip, limited to your name, photograph, GuyWay driver ID, the Vehicle registration, the location of the Vehicle from the acceptance of the trip until its end, the messages and voice notes you send to the rider and the trip receipt described in clause 5.1 of the Platform Agreement;
(e) an AI service provider, currently OpenAI, to which the photographs of a document you scan are sent only so that the printed details can be read. The provider may be located outside Guyana. GuyWay has instructed the provider not to store the photographs or the details read from them and not to use them to train its models.
(f) a translation service provider, to which the written messages between you and a rider are sent only so that they can be translated, with names, telephone numbers and trip PINs removed. The provider may be located outside Guyana.
6. How long we keep it

Where an accident, claim, complaint, investigation or legal proceeding is open or is reasonably expected, GuyWay keeps the information relating to it until the matter is closed and the time for bringing any claim has expired. Where a person injured in an incident is a minor, that time runs from the date the minor reaches the age of majority.
These periods are the longest that the laws of Guyana support: the Income Tax Act, Cap. 81:01, section 65 (eight years), the Value-Added Tax Act 2005, section 60 (seven years) and the Limitation Act, Cap. 7:02, sections 3, 6 and 8 (six and three years). At the end of a period the information is deleted or made anonymous.
7. Your rights
(a) You may ask to see the information GuyWay holds about you.
(b) You may ask GuyWay to correct anything that is wrong.
(c) You may ask GuyWay to delete information it no longer has a legal or contractual reason to keep.
(d) You may complain to GuyWay and, once the Data Protection Act 2023 is in force, to the Data Protection Commissioner.
GuyWay will respond to any request within thirty (30) days. This notice is not a consent that you give and may withdraw: the processing it describes is needed to perform your Platform Agreement and your Rental Agreement, and your agreement to it is contained in clause 8.2 of the Platform Agreement.
8. Hub closed-circuit television
The hub is monitored by closed-circuit television for the security of the fleet and to record the condition of each Vehicle at delivery and at return. Footage is kept for the periods stated in section 6 and may be used to resolve a dispute about damage to the Vehicle under clause 8 of the Rental Agreement. Signs are displayed at the hub.
9. Changes to this notice
GuyWay maintains this notice with the Driver Standards and may update it in accordance with clause 5.3 of the Platform Agreement. The current version is dated and is available at all times in the driver application and on the GuyWay website. A change which materially increases the information collected or widens the persons to whom it is disclosed takes effect thirty (30) days after notice to you. A new version of this notice is published in the driver application and is acknowledged there in the manner described under the heading Acknowledgement below.

Acknowledgement
You acknowledge this notice in the driver application. The application shows you this notice in full and asks you to confirm the statement: "I have read the Driver Data Notice, version 1.6, dated 5 October 2026, and I understand it."
When you confirm it, GuyWay records against your account the full name you typed, your GuyWay driver ID, the version number and version date of this notice, the SHA-256 hash of the text shown to you, and the date and time of your confirmation in Guyana time. GuyWay keeps that record for as long as it keeps the records described in section 6 and keeps it available to you in the driver application.
Where you are unable to use the driver application, you may acknowledge this notice by signing and dating a printed copy of it, and that acknowledgement has the same effect.
Acknowledging this notice is not a consent that you give and may withdraw, and it does not add to or change your Platform Agreement or your Rental Agreement. It records that the notice was shown to you and that you read it. Section 7 explains what you may ask GuyWay to do about your information.
